Terms and Conditions

These terms explain how GoLive website projects, retail storefront setup, launch support, third-party tools, ownership, payment, and handoff work. Last updated June 4, 2026.

Plain English note

These website terms are general service terms. A written proposal, statement of work, invoice, deposit page, or signed agreement may add project-specific details. If those project-specific terms conflict with this page, the signed or accepted project-specific terms control for that project.

1. Acceptance of these terms

These Terms and Conditions apply to GoLive, the website and launch-support business operating at golivenh.com, and to clients or prospective clients who submit a launch request, approve a proposal, pay a deposit, approve work, use delivered files, or otherwise work with GoLive.

Submitting the launch request form alone does not guarantee acceptance of a project, lock final scope, or create an obligation for GoLive to begin paid work. Paid work begins only after scope, price, timeline, and the next step are agreed to in writing or by deposit/payment.

2. Business identity, trade name, and future entity updates

For these terms, “GoLive” means the website development and launch-support provider identified on this website, in a proposal, invoice, deposit page, or written project communication, including its owner, authorized representatives, successors, and permitted assigns.

If GoLive forms or transfers work to a limited liability company or other business entity, these terms may continue to apply to new or ongoing GoLive projects unless a project-specific written agreement states otherwise. Client-facing proposals, invoices, and payment records should identify the correct contracting party for the project.

Clients should not rely on this website as proof of entity status, insurance coverage, licensing, tax treatment, or legal standing. Those details may be confirmed in the project proposal, invoice, or other written records.

3. Services and scope

GoLive provides website design, website development, content organization, launch support, request-form setup, basic local visibility guidance, retail storefront setup, and related small-business web services. The exact work for each project is defined by the accepted proposal, invoice, statement of work, or written project notes.

  • Package names and pricing shown on the website are starting points or examples unless a specific proposal says otherwise.
  • Any work not listed in the accepted scope may require an added quote, change order, or separate support plan.
  • Timeline estimates depend on client approvals, asset delivery, DNS/domain updates, third-party tools, payment providers, and platform availability.

4. Client responsibilities

The client is responsible for providing accurate business information, approvals, brand assets, product or service details, photos, policies, pricing, and any legal or regulatory information that applies to the client’s business.

  • The client confirms that they own or have permission to use all logos, photos, copy, trademarks, customer reviews, product images, and other materials provided to GoLive.
  • The client should not send passwords, credit-card numbers, API keys, private customer records, protected health information, or sensitive data through the public website form.
  • Where possible, the client should own and control their domain, hosting, Google, email, payment, checkout, POS, and business accounts.
  • The client is responsible for reviewing the website before launch and telling GoLive about needed corrections.
  • The client is responsible for maintaining accurate business registration, trade name, license, insurance, privacy, refund, tax, accessibility, and customer-facing policy information for their own business.

5. Retail, checkout, POS, inventory, and payments

Retail positioning: GoLive builds the branded website and connects the selling system. Stripe, Square, Shopify, payment links, POS tools, shipping tools, tax settings, order records, inventory logic, and customer payment processing should live inside the client’s chosen third-party platform and client-owned accounts.

  • GoLive does not act as the merchant of record, payment processor, tax advisor, accountant, POS provider, inventory manager, shipping carrier, or fulfillment provider.
  • The client is responsible for product accuracy, pricing, taxes, shipping/pickup rules, refund and return policies, fulfillment, customer service, prohibited/restricted products, and any industry-specific rules.
  • CSV, XML, API, or inventory-feed imports may be available as a scoped add-on when the client’s source system and data format support it.
  • Third-party checkout, tax, payment, inventory, and order tools are governed by their own terms, fees, rules, account settings, risk reviews, approval decisions, and compliance requirements.

6. Ownership, files, and portfolio use

After GoLive receives full payment for a project, the client owns the final website files and client-specific content created for that project, except for GoLive’s pre-existing tools, reusable code patterns, workflow methods, internal templates, third-party assets, open-source software, stock assets, or platform-owned materials.

  • GoLive may reuse general ideas, code patterns, layout techniques, processes, and non-client-specific know-how across projects.
  • Unless the client asks in writing before launch, GoLive may show the finished project, screenshots, business name, and general project summary in its portfolio, examples, case studies, or marketing.
  • Third-party platforms, fonts, stock assets, plugins, checkout providers, and embedded services remain governed by their own license terms.

7. Payments, deposits, cancellations, and changes

Payment terms are stated in the accepted proposal, invoice, deposit page, or written project notes. Unless a proposal says otherwise, a deposit may be required before GoLive reserves build time or begins project work.

  • Deposits become earned as project planning, design, development, consulting, setup, or scheduling work begins and may be non-refundable to the extent work has been performed or time has been reserved.
  • Past-due balances may pause launch, revisions, handoff, support, or additional work until payment is current.
  • Requested changes outside the approved scope may require a new estimate, added payment, or revised timeline.
  • Recurring support, maintenance, content updates, analytics review, or marketing help are separate unless included in writing.
  • Client approval by email, text, form submission, payment, or other written confirmation may be treated as authorization to proceed with the described work.
  • If a client stops responding, withholds required materials, or delays approvals, timelines may be extended and GoLive may pause the project until the client reconnects.

8. Third-party services and accounts

GoLive may help connect or configure tools such as Netlify, Cloudflare, Formspree, Google Business Profile, Google Analytics, Google Search Console, Stripe, Square, Shopify, email providers, social platforms, booking tools, maps, embeds, plugins, or other services.

Those third-party services are not controlled by GoLive. GoLive is not responsible for their outages, price changes, policy changes, account suspensions, approval decisions, deliverability, data retention, security incidents, platform limitations, or feature changes.

Project proposals may include estimated client-owned software costs for planning purposes, such as booking tools, ecommerce platforms, POS, domains, email, hosting, or payment providers. These estimates are not GoLive fees unless expressly stated in the accepted proposal, and the provider’s actual pricing, processing fees, taxes, plan changes, or billing rules control.

10. Support, maintenance, and no guaranteed results

Any included launch support is limited to the scope, time period, and tasks stated in the accepted proposal or written project notes. After included support ends, additional updates, troubleshooting, redesigns, platform changes, marketing help, analytics review, or content work may require a separate support plan or quote.

GoLive does not guarantee search rankings, Google Business Profile approval, review counts, traffic, leads, sales, revenue, conversion rate, social growth, uptime, email deliverability, payment-provider approval, platform availability, platform policy compliance, or any specific business outcome.

Any local visibility, search-friendly structure, Google Business Profile, review-request, content, or launch checklist support is educational and implementation support only. It is not a promise of placement, ranking, approval, traffic, leads, sales, or revenue.

11. Confidentiality

GoLive will use reasonable care with non-public business information shared for a project. The client should not send highly sensitive information through public forms or ordinary email unless a safer process has been agreed to. A separate NDA or confidentiality agreement may be used when a project requires it.

12. Limitation of liability and indemnity

To the fullest extent permitted by law, GoLive will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, including lost sales, lost leads, lost data, account issues, platform downtime, payment-provider issues, or business interruption.

To the fullest extent permitted by law, GoLive’s total liability for any claim related to a project, website, support request, third-party setup, or delivered file is limited to the amount the client paid GoLive for the specific service or project that gave rise to the claim during the three months before the event giving rise to the claim. Nothing in these terms limits liability that cannot legally be limited.

The client agrees to defend, indemnify, and hold GoLive harmless from claims, losses, costs, damages, or expenses arising from client-provided content, client products or services, customer disputes, taxes, regulated products, intellectual-property claims, account misuse, privacy practices, fulfillment, or the client’s violation of these terms or applicable law.

13. Governing law and disputes

These terms and GoLive projects are governed by the laws of New Hampshire, without regard to conflict-of-law rules. Before filing a claim, the parties agree to make a good-faith effort to resolve the issue informally by email or phone and allow a reasonable opportunity to cure when a cure is possible.

If a dispute cannot be resolved informally, the parties agree that claims may be brought in the appropriate state or federal courts located in New Hampshire. Where venue rules allow, the parties agree to New Hampshire venue, including Cheshire County, New Hampshire. If a claim qualifies for New Hampshire small-claims court, either party may use that process. Nothing in this section prevents either party from seeking urgent court relief for misuse of confidential information, intellectual property, accounts, or systems.

14. Electronic communications and records

The client agrees that project communications, approvals, proposals, invoices, payment links, forms, emails, electronic signatures, click-through acknowledgments, and electronic records may be used for GoLive projects, unless a different written process is required by law or agreed to in writing. The client agrees to keep copies of important project records and to tell GoLive promptly if contact information changes.

15. Updates to these terms

GoLive may update these terms from time to time. The version posted on this page applies to website use and new project activity after the posted update date. Project-specific signed or accepted terms continue to apply as stated for that project.
